Concept Note on e-FIR Model has been prepared by NCRB. Head Concept Note. The Ministry of Home Affairs has been sent to all the States / UTs from the number (1) read by the Government of India and it is also suggested to implement e-FIR to increase the online services provided by the government to the citizens.



           The e-FIR facility has been provided in the e-FIR module of CCTNS in case of vehicle / property theft offenses in which the accused is unknown, according to the Ministry of Home Affairs, Government of India from the number (3) read. Similarly, the Ministry of Home Affairs, Government of India has suggested to take action to develop e-FIR facility in all the States / UTs and provide it to the citizens. Therefore, the implementation of e-FIR was also under active consideration by the State Government.


Resolution


At the end of the adult deliberation, in case of vehicle theft / mobile phone theft, the State Government has decided to facilitate e-FIR in the wider interest of the citizens through Citizen Portal / Citizen First Mobile App and the procedure for this will be as under,


A) e-FIR Procedure:


Gujarat Police will provide e-FIR facility to citizens through vehicle portal / mobile phone theft through Citizen Portal (https://gujhome.gujarat.gov.in) / Citizen First Mobile App. This e-FIR facility can be availed only in cases where the accused is unknown and no force has been used / injured during the incident. After completing the preliminary investigation of e-FIR within a certain time limit, such complaint will be converted into FIR as per its facts, the procedure of which is as under -


Citizens will be able to access e-FIR service through Citizen Portal / Citizen First Mobile App.

          The complainant will have to register on the Citizen Portal Citizen First mobile app and upload the details online regarding the vehicle / mobile phone theft complaint. Of the application submitted by the plaintiff at the time of applying online


After taking the printout, after signing it yourself, the signed application has to be scanned and uploaded.



                  Complainant will be informed of receipt of complaint form by e-mail / SMS, e-FIR will be forwarded to the police station named by the complainant in the details of the incident and if the name of the police station is not mentioned then it will be forwarded to the Commissioner of Police / Superintendent of Police. The office will forward the T-FIR and the office of the Commissioner of Police / Superintendent of Police will send the e-FIR to the concerned police station immediately. By logging in to Gujkop, he will be able to see the e-FIR in the portal worklist and in any case, he will have to send the officer / employee on duty to the police station for a preliminary investigation within a time limit of 2 hours.


E-Mail about assigning the investigating officer as well as the complainant to the investigating officer when the preliminary investigation will be handed over to the investigating officer on duty at the police station.


Will be notified by SMS.



                    The investigating officer will make necessary study of the first e-FIR after receiving such e-FIR and will contact the complainant within 7 hours of uploading the e-FIR, verify the relevant documents and visit the scene of vehicle theft / mobile phone theft. The entire process will be completed within 3 hours of the B-FIR being uploaded and a preliminary investigation report on the e-FIR will be sent to the station in-charge.



                  The station officer will properly dispose of the e-FIR within 2 hours of receiving this report. If the details of e-FIR are correct then FIR will be entered in e-Gujkop. If the scene of the incident does not fall within the jurisdiction of his police station, he will send the e-FIR to the concerned police station. If the e-FIR contains false documents and incorrect details, the application will be filed. Within 2 hours (within 3 days) of uploading e-FIR from Citizen Portal / Citizen First Mobile App, the Station Officer will have to dispose of the FIR in this manner.

                    The e-FIR should be disposed of within 3 hours of uploading, otherwise the e-mail / SMS regarding the pending e-FIR will immediately go to the Deputy Superintendent of Police, Assistant Commissioner of Police. As further legal action will have to be taken. In addition, the Commissioner of Police / Deputy Commissioner of Police / Superintendent of Police will take disciplinary action against the concerned officer of the police station for not taking standard action on e-FIR within the time limit of 150 hours.


Complainant will be informed by E-Mail / SMS regarding e-FIR, whether FIR has been filed or not.


In case of registration of FIR, a copy of the plaintiff's FIR from the Citizen Portal

Fill in the chargesheet or final report within 60 days of admission.


If no chargesheet or final report is received within 30 days of filing the FIR, Deputy


The Superintendent of Police / Assistant Commissioner of Police will be notified by E-Mail / SMS. If no action is taken within 7 days then the Superintendent of Police will inform the Deputy Commissioner of Police / Commissioner of Police through E-Mail / SMS.


(B) Responsibility of Thana Officer


1) When the station officer received the e-FIR, he took immediate action on the e-FIR


The e-FIR has to be given for preliminary investigation, based on the report given by the primary investigating officer (within 2 hours of uploading the e-FIR) - it has to be seen that the disposal of FIR takes place within 2 hours of receiving the report. Thus the entire process has to be completed within 3 hours of receiving the e-FIR. 2) Monitoring the timely disposal of vehicle / mobile phone theft FIR


Will have to do. 3) From time to time the investigating officers of the police station should be made aware of the e-FIR system and trained in this regard.


(A) Responsibility of Divisional Police Officer / Assistant Commissioner of Police / Deputy Commissioner of Police


1) Monitoring of e-FIR disposal in time. 2) Check the e-FIR in the file and see if it is properly filed.


3) With regard to e-FIR, after registration of FIR, it will be necessary to see that the investigation is completed within 30 days.


4) Informing the concerned station officer about e-FIR system from time to time and training in this regard

(D) Responsibility of Commissioner of Police / Superintendent of Police


1) With regard to e-FIR, monitoring should be done to ensure that legal action is taken as per the above instructions within the stipulated time frame.


2) In case of non-action within the prescribed time with regard to e-TR, the responsibility of the concerned officer of the police station will be determined and disciplinary action will be taken against them.


The system as per the above procedure should be implemented immediately by the Director General of Police and Chief Police Officer, State of Gujarat. By order of the Governor of Gujarat and in his name,
